Kingsdown Privacy Policy

Effective Date: September 16th, 2026

At Kingsdown, Inc. ("Kingsdown," "we," "us," or "our") we recognize that privacy is very important to our customers. This Privacy Policy explains what personal information we collect, how we use and share it, and the choices and rights available to you — including the rights California and other U.S. residents have under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (together, "CCPA"), and the rights residents of the European Economic Area, the United Kingdom, and Switzerland have under the General Data Protection Regulation and UK GDPR (together, "GDPR") — see "Your Rights Under GDPR" below.

Our Privacy Policy

When you place an order with us, or register for products or services, Kingsdown requests information from you that is required to complete your order or registration. We never disclose your personal information to third parties for a third party's own direct-marketing purposes, and we do not sell your personal information for money. We do work with advertising and analytics partners (described below) who help us run and measure our ads — under California law, that kind of arrangement is treated as "sharing" your information even though no money changes hands, so we describe it that way throughout this policy and give you a way to opt out of it.

Placing an Order with Kingsdown

When you order, we request the following information: name, address, daytime phone number, and e-mail address if you prefer to correspond with us via e-mail. When you submit an order, this information is recorded, along with the IP address of the computer used to place the order. If you pay by credit or with debit card, our payment processor records the card number and expiration date to authorize the purchase. The contact information you provide is used to ship the order and/or to contact the purchaser if there's a question about it. Newsletter and Communications With You

We may e-mail you for marketing purposes. For example, when you register for product information or order online from us and provide your e-mail address, in addition to periodic updates related to your products, you will receive our e-mail newsletter. If you decide you do not wish to receive it, there are clearly marked opt-out instructions at the bottom of each e-mail, or you can contact us using the methods in "Your Privacy Rights" below.

If you're located in the European Economic Area, the United Kingdom, or Switzerland, we'll only send you marketing e-mail if you've given us affirmative opt-in consent (for example, by checking a signup box) — except that, if you're an existing customer, we may e-mail you about similar products or services you've previously purchased or asked about, and you can opt out of that at any time using the unsubscribe link or the contact methods below

We may also e-mail you or otherwise use your information to respond to your requests or questions, share information about your products or items you requested, or notify you of special sales or promotions. We may also send you transactional communications about your order, about selling to us, or about your experience with Kingsdown.

Kingsdown reserves the right to contact users to correct account errors or supply important information we deem relevant, to the extent permitted by law.

Online Gift Cards

If you purchase a gift card online, we ask for information about the recipient to complete the order you've placed for them. If a receipt or gift card is misplaced, we may inform the gift card holder of the purchaser's name.

Cookies, Pixels, and Similar Technologies

Cookies are small amounts of data used to "remember" your visit and preferences, and to support e-commerce features like a shopping cart. Kingsdown uses session cookies to identify items you've expressed interest in while visiting our site, such as items added to a cart or our registration form. Kingsdown's own cookies are not used to identify, save, or retrieve your financial account information.

We use Consentmo, a cookie-consent management platform, to categorize the cookies and tracking scripts on our site and to manage your consent choices. Depending on where you're visiting from:

  • If you're in the European Economic Area, the United Kingdom, or Switzerland, Consentmo blocks non-essential cookies — including analytics and advertising cookies — until you affirmatively opt in through the cookie banner. You can change your choice at any time through the "Cookie Preferences" link https://kingsdownmattress.com/pages/your-privacy-choices in our footer.
  • Elsewhere, including the United States, non-essential cookies may run by default, and you can opt out through the same "Cookie Preferences" link or the browser- and network-level tools below.

Consentmo keeps a timestamped record of each visitor's consent choices as proof of compliance and only allows Google Analytics and advertising tags to fire in line with the consent status it records (via Google Consent Mode).

We also work with other companies to help serve, manage, and measure our products and advertisements online, including:

  • Google Analytics, to help us understand how visitors use our site — see Google's privacy policy and Google's opt-out tool.
  • Third-party advertising networks (for example Google, Meta/Facebook, and Microsoft/Bing), which may use cookies, pixels, or web beacons to show you Kingsdown ads on other websites based on your visit to our site ("retargeting") and to measure ad performance.

These companies may collect information about your visits to our site, other websites, and your interaction with our ads. Under California law, this is "sharing" for cross-context behavioral advertising — see "Your Privacy Rights" below for how to opt out, including via the Global Privacy Control browser signal. Under GDPR, running these cookies for EEA/UK/Swiss visitors is based on your consent, captured through Consentmo as described above.

How We Share Information

We do not sell personal information to third parties for money. We share personal information with the following categories of recipients, only as needed for them to perform their work for us, and under contracts that require them to protect it and use it only for the purposes we specify:

  • Service providers and contractors: order fulfillment and package delivery, payment processing, e-commerce platform hosting (Shopify), customer service, e-mail and postal delivery, and data analysis.
  • Advertising and analytics partners: Google Analytics and the advertising networks described above, for the cross-context behavioral advertising described in "Cookies, Pixels, and Similar Technologies." This is the "sharing" activity you can opt out of below.
  • Third-party data providers: to keep our customer records current and accurate (for example, updated mailing addresses), and, where you've asked us to send a gift to someone else, that recipient's name and address.
  • Legal and safety: when required by law, to comply with legal process, or to protect the rights, property, or safety of Kingsdown, our customers, or others.
  • Business transfers: if some or all of our business assets are sold or transferred, the corresponding customer information may transfer as part of that deal; we may also retain a copy.

If we ever begin selling personal information for money, or expand the categories of information we share for cross-context behavioral advertising, we'll update this policy and the disclosures in "Your Privacy Rights" below.

Protection of Kingsdown and Others

We reserve the right to disclose your personally identifiable information in special cases, such as when required by law, to comply with a judicial proceeding, court order, or legal process served on us, to enforce or apply our terms and other agreements, or to protect the rights, property, or safety of our company, our customers, or others.

Server Log Files

As is standard practice online, our web servers record non-personal information in an industry-standard server-log format, including the computer's IP address, browser type, and referring URL. We analyze this information to understand usage trends and improve our site.

Your Rights Under GDPR (EEA, UK & Switzerland)

This section applies if you're located in the European Economic Area, the United Kingdom, or Switzerland, and supplements the rest of this policy. Kingsdown, Inc. is the "controller" of your personal data for purposes of the General Data Protection Regulation and UK GDPR (together, "GDPR").

Our Legal Bases for Processing

We only process your personal data where we have a legal basis to do so:

  • Contract: to take steps at your request before entering into a contract, and to perform our contract with you — for example, processing your order, taking payment, and arranging delivery.
  • Legal obligation: for example, keeping records needed for tax, accounting, or consumer-protection law.
  • Consent: for non-essential cookies and analytics/advertising tags (managed through Consentmo, see "Cookies, Pixels, and Similar Technologies" above), and for marketing e-mail unless the "existing customer, similar product" exception described in "Newsletter and Communications With You" applies. You can withdraw consent at any time without affecting the lawfulness of processing before withdrawal.
  • Legitimate interests: for example, keeping our site secure, preventing fraud, running our server logs and basic site analytics, and marketing to existing customers as described above — always balanced against your rights and interests, and you can object at any time (see "Your Rights," below).

International Data Transfers

Kingsdown is based in the United States, and our service providers — including Shopify (our e-commerce platform) and Google (Analytics and advertising) — process personal data in the United States and other countries outside the EEA/UK/Switzerland. Where we or our providers transfer personal data out of the EEA, UK, or Switzerland, we rely on the providers' Standard Contractual Clauses and other safeguards approved under GDPR Article 46 (for example, Shopify's Data Processing Addendum and Google's EU/UK/Swiss Standard Contractual Clauses), rather than relying on your consent as the transfer mechanism for this ongoing processing.

Your Rights

Subject to certain exceptions, you have the right to:

Erasure Have your personal data deleted in certain circumstances — for example, where it's no longer needed for the purposes it was collected for.

Portability Receive personal data you've provided to us in a structured, machine-readable format, or have it transferred to another provider, where our processing is based on consent or on performing a contract with you.
Object Object at any time to processing based on our legitimate interests, including profiling, and object at any time to processing for direct marketing, including profiling for marketing purposes — we'll stop unless we have compelling grounds that override your rights.
Withdraw Consent Withdraw consent at any time for any processing we base on consent (for example, non-essential cookies or opt-in marketing), without affecting the lawfulness of earlier processing.
Complain Lodge a complaint with your local data protection supervisory authority. Complaints about Kingsdown may also be raised with the UK Information Commissioner's Office (ico.org.uk) if you're in the UK.

We do not make decisions about you based solely on automated processing (including profiling) that produce legal or similarly significant effects.

How to Exercise Your GDPR Rights

You can exercise any of these rights by contacting us at online@kingsdown.com or by mail at Kingsdown, Inc., Attn: Kingsdown Marketing, PO Box 388, Mebane, NC 27302, United States. We may need to verify your identity before responding, and will respond within one month, extendable by a further two months for complex or numerous requests (we'll tell you if that extension applies and why).

Data Protection Officer: we have not appointed a Data Protection Officer, because our processing doesn't involve large-scale, systematic monitoring of individuals or large-scale processing of special-category data.

Children

As described in the "Children" section below, we do not knowingly collect personal data from anyone under 16.

Privacy Notice for California Residents

This notice supplements the information above and applies to California residents ("consumers" or "you"), consistent with the California Consumer Privacy Act as amended by the California Privacy Rights Act ("CCPA"). Terms defined in the CCPA have the same meaning here.

We do not knowingly collect or sell the personal information of consumers we know to be under 16 years of age. See "Children" below.

Sensitive Personal Information

We do not collect sensitive personal information as defined by the CCPA (for example, government ID numbers, precise geolocation, racial or ethnic origin, religious beliefs, health information, or account log-in credentials in combination with the password or security code needed to access the account) beyond what may be required to process a payment, which is handled by our payment processor.

Sources of Personal Information

We collect personal information directly from you (when you place an order, register, or contact us), automatically from your device as you use our site (cookies, server logs, analytics tags), and from our service providers and advertising partners.

Business Purposes for Collecting and Using Personal Information

  • Fulfilling orders, processing payments, and providing customer service
  • Sending product, order, and account communications, and marketing communications you haven't opted out of
  • Operating, securing, and improving our website and services
  • Measuring and improving our advertising, including the cross-context behavioral advertising described above
  • Detecting security incidents and fraudulent or illegal activity
  • Complying with legal obligations

Selling and Sharing of Personal Information

We do not sell personal information for money. We do share the categories of personal information marked "Yes" in the "Shared" column above — generally identifiers, commercial information, and internet/network activity — with our advertising and analytics partners (Google, Meta/Facebook, Microsoft/Bing, and similar networks) for cross-context behavioral advertising. California law treats this kind of sharing the same as a sale for purposes of your opt-out right below.

How Long We Keep Personal Information

We keep each category of personal information only as long as reasonably necessary for the purposes described above, or as required by law. As a general guide:

  • Order, account, and transaction records: for the length of our relationship with you, plus up to 10 years for warranty requirements afterward.
  • Marketing/newsletter records: until you unsubscribe, or after a period of inactivity of 3 years.
  • Website analytics and advertising identifiers: per our analytics and advertising partners' retention settings — currently 2 months.

Where we don't retain information for a fixed period, we determine how long to keep it based on the amount, sensitivity, and purpose of the information, and any legal or accounting requirement to keep it longer.

Your Privacy Rights

Subject to certain exceptions, California residents have the right to:

Appeal If we decline a request, you may appeal by replying to our denial notice or contacting us using the methods below; we will respond to your appeal within 45 days. If we deny your appeal, you may file a complaint with the California Privacy Protection Agency.

Do Not Sell or Share My Personal Information

You can opt out of the sharing described above at any time by clicking "Your Privacy Choices" https://kingsdownmattress.com/pages/your-privacy-choices— this is powered by Consentmo, our cookie-consent platform, which also shows a California-specific banner to California visitors. We also honor the Global Privacy Control (GPC), a browser or extension signal that automatically communicates an opt-out request — if we detect a GPC signal from your browser, we will treat it as a valid opt-out request for that browser.

How to Exercise Your Rights

You, or an authorized agent acting on your behalf, may submit a verifiable consumer request using either of these methods:

We'll ask for information reasonably necessary to verify your identity and may deny a request we can't verify. You may make an access or portability request up to twice in a 12-month period. If you use an authorized agent, we may also require proof of the agent's authority to act on your behalf and, separately, verification of your own identity.

We'll respond within 45 days of receiving a verifiable request; if we need more time (up to an additional 45 days, 90 days total), we'll tell you why in writing before the initial period ends. We don't charge a fee to process a request unless it's excessive, repetitive, or manifestly unfounded, in which case we'll explain why and provide a cost estimate first.

Requests on Behalf of a Minor

A parent or guardian may make a verifiable consumer request on behalf of their minor child. We do not sell or share the personal information of consumers we know to be under 16 years of age without affirmative authorization — from the consumer if they are between 13 and 16, or from a parent or guardian if the consumer is under 13.

Financial Incentives

We do not currently offer a financial incentive or price/service difference in exchange for personal information within the meaning of the CCPA. If that changes, we'll describe the material terms here and obtain your prior opt-in consent, which you may revoke at any time.

"Shine the Light"

California's "Shine the Light" law (Civil Code § 1798.83) lets California residents request information about our disclosure of personal information to third parties for their own direct marketing purposes in the prior calendar year. As explained above, we do not make such disclosures; if you'd still like to submit a request, use the contact methods above.

Children

We do not knowingly collect, store, share, or use the personal data of children under 16 years old. If you are under 16, please do not provide us with personal data, even if prompted to do so. If you're under 16 and have provided personal data, please ask your parent or guardian to notify us at online@kingsdown.com and we will delete it.

General

Visitors Outside the United States

Our website is hosted in the United States. If you visit from outside the United States, your information may be transferred to, stored, and processed in the United States, where data protection laws may differ from those in your country. If you're in the EEA, UK, or Switzerland, see "Your Rights Under GDPR" above for the specific safeguards that apply to that transfer.

Changes to This Privacy Policy

We may update this Privacy Policy to reflect changes in our practices by posting a notice on our website. Updates take effect immediately upon posting. If a change materially affects previously collected personal information, we'll notify you by e-mail if we have your e-mail address on file. Please check this page periodically.
